understanding Do for the disposing of that Estate which it hath pleased Almighty
God to bless me with, make my last Will and Testament in manner and form
following.
And first I commend my soul to God and my Body to the earth to
be buried in such decent manner as my Executrix herein after named shall think
fit.
Also I give and devise all that messuage or tenement in Weald
aforesaid wherein I now dwell together with the outhouses, garden and orchard
and all and singular the premises with the appurtenances except that part of the
messuage or tenement and garden now occupied by my kinswoman Martha Carter
and her family with the two rows of apple trees situate on the east side of the
orchard which I give and devise to the said Martha Carter for and during the
natural life of widowhood of my said wife which said premises I purchased of and
from Walter Webb, Abraham Puddle and Richard Matcham all late of Weald
aforesaid.
Unto my beloved wife Sarah Baston for and during so
much of the term or terms which I have therein as she shall happen to live and
remain in widowhood and from -------- and after the decease or second marriage
of my said wife whichever shall first happen, I give and devise all the
aforesaid messuage, orchard and premises with the appurtenances unto my said
kinswoman Martha Carter her Executor Administration and assigns for and
during all the residue and remainder of my Estate term or terms and interest
which shall be therein then to come and unexpired.
Also I give and
bequeath unto my kinsman John Baston, William Baston, Jonathan Baston, Edward
Baston and Francis Baston sons of my late brother William Baston the sum or
legacy of five shillings apiece to be paid within three months next after my
decease.
And as for and concerning all my goodes, Chattels, ready money,
debts owing to me and personal estate of what nature or kind so ever which shall
remain after payment of all my just debts legacies and funeral expenses, I give
and bequeath the same unto my said wife Sarah Baston to and for her own
separate use and benefit.
And I do hereby make constitue and appoint my
said wife sole executrix of this my last will hereby revoking all former wills
by me heretofore made.

The last Will & Testament of Francis
Baston of Glympton Lodge in the parish or liberty of Glympton in Woodstock in
the county of Oxford, yeoman. First I direct that all my just debts funeral and
testamentary expenses to be paid by my executors hereinafter named as soon as
may be necessary after my decease out of my personal estate.
I give,
devise and bequeath unto Thomas Skinner of Witney in the said county, salesman
and my nephew John Baston of Aston Clinton in the county of Berkshire,
gentleman all and every my messuage lands tenements and affidavits? and all my
personal estate monies, securities for money, debts, goods, chattels and effects
whatsoever and wheresoever except my wearing apparel which I shall die origin of
or possession of or entitled unto hold the same unto the said Thomas Skinner and
John Baston their heirs executors admons assigns upon trust to collect call in
and compel payment of all debts and monies which shall be owing to me at the
time of my decease in such manner as they or survivor of them shall think fit
and I do authorize and empower my said trustees and the survivor of them to
compromise or compound or submit to arbitration any sum of sums of money which
may be owing or appear to be owing to me at the time of my decease and to give
or allow such reasonable time for payment thereof as they or he shall think
proper and upon receipt of such monies or any part thereof upon trust that they
my said trustees or the survivor of them do and shall put and place the same out
at interest upon covenant or real security and from time to time call in and
replace the same or any part thereof and transfer and dispose of all or any of
the securities whereupon the said trust monies shall be then placed out or
invested as they or he my think proper and do and shall pay the interest
dividends or annual profits arising there from together with the rents assigns
and profits of my said messuages and real estate unto the proper hands of my
daughter Elizabeth Baston for and during the term of her natural life by
equal half yearly payments and I do hereby direct and declare that her receipt
alone notwithstanding any future -our-ure (coveture?) shall at all times be a
good and sufficient discharge to my said trustees for the same and that such
rent interest and provides shall otherwise be subject or liable to the control
of any husband she my hereafter marry nor shall the same or any part thereof be
subject or liable to his debts or engagements and from and immediately after the
decease of my said daughter upon further trust that they my said trustees and
the survivor of them and his heirs do and shall sell absolutely dispose of my
said messuages and real estate and every part thereof either together or in
parts and either by public auction or private contract as they or he shall think
best for such principle or principles or sum or sums of money as in their or his
opinion may be obtained or reasonably expected for the same and to convey the
affidavits and promises and shall be so sold to the purchaser or purchasers
thereof and do and shall stand and let possession of the monies arising by such
sale or sales upon trust to pay share and divide the same and also the monies
hereinbefore directed to be paid out at interest for the benefit of my said
daughter unto amongst all and every my nephews and nieces, sons and daughters
of my brothers John Baston, William Baston, Thomas Baston, Edward Baston and
Jonathan Baston who shall be living at the time of the decease of my said
daughter equally share and share alike or their legal representatives to whom
respectively I hereby give and bequeath the same and direct the same to be paid
and divided as soon as conveniently can be after the decease of my said
daughter.
I give unto my nephew Francis Baston, son of my said
brother William all my remaining apparel of every description
I give
unto my said trustees Thomas Skinner and John Baston five guineas each and I do
hereby declare and direct that the receipt or receipts of my said trustees or
the survivor of them or their or his heirs executors or admons shall be good and
sufficient discharge or discharges to the purchase or purchasers of my said real
estate or any part thereof and also to any mortgagor or other person or persons
paying in any mortgage or other monies placed out at interest as hereinbefore
directed or any debt or debts sum or sums of money due to me at the time of my
decease for such sum or sums of money which shall be by him her or them paid to
my said trustees in respect of such purchase or mortgage money security or debt
or debts or so much thereof as in such receipt or receipts shall be acknowledged
to by ------- and that no such purchaser mortgagor or other person or persons
after paying such monies to my said trustees shall be answerable for or be
obliged to see to the application or in any respect accountable for or by reason

John Baston of Aston Clinton the nephew of Francis Baston was born 1772 in Aston
Clinton. " Mention of William in his brother Francis' 1819 Will. my
nephews and nieces, sons and daughters of my brothers John Baston, William
Baston, Thomas Baston, Edward Baston and Jonathan Baston I give unto my
nephew Francis Baston, son of my said brother William."

Thoughts
on sorting out the children of William Baston who married Mary Honeybone 21st
July 1755 & William Baston who married Mary Fox 11th November 1755.
John
Baston 12 Oct 1755 baptised before Mary Fox married so is to Honeybone.
Richard Baston 22 Feb 1756 too soon for Honeybone, therefore must be Fox .
The 1819 Will of Francis Baston, buried 1820 Glympton age 80 years (making him
born c1741), fits the baptism of Francis Baston to William & Elizabeth (Skinner)
Baston of Bampton. This Will names the following people, his daughter Elizabeth
(Francis married Jane Horton 21 Mar 1766 in Glympton and Elizabeth was there
only child) and his brothers John, William, Thomas, Edward & Jonathan together
with Francis the son of his brother William (note there are three separate Wills
which show that there were both John & Jonathan in the same families). Jonathan
Baston of the Weald, Bampton's 1777 Will (Francis' uncle) also cites the same
names as sons of his brother William. The John Baston, nephew of Aston Clinton
named as Executor of Francis' 1819 Will, appears to be a son of Edward Baston (m
Jane Panting 1764 Aston Clinton) who was also one of the brothers named.
All these brothers, as does the baptism of Francis himself, match with the
baptisms to William & Elizabeth (Skinner) Baston; William 1732, Thomas 1738,
Edward 1737, Jonathan 1739 as does the baptism of a Francis in 1764 to a William
& Mary. The only baptism missing is of a John to William & Elizabeth. I can
find no other Baston/Basson family that fits the named brothers better.
The other baptisms to a William & Mary are: -
Mary Baston
13 May 1758 to Wm & Mary of Aston. (Probably Fox as
Richard was of Aston and Mary Fox) William Baston 17 Sep
1758 to Wm & Mary (no mention of Aston and to soon after Mary, therefore
Honeybone). William Baston 10 Feb 1760 to Wm & Mary of Aston
(note; no burials for a William except 3 Mar 1758 which is before either
William born, so not a rename, therefore probably Fox, is also of Aston.)
Thomas Baston 8 Mar 1761 to Wm & Mary (probably Honeybone as
no Aston mentioned) Joan Baston 16 Jun 1762 to Wm &
Mary of Aston (Fox as Aston) Elizabeth Baston 22 Jan 1764 to
Wm & Mary of Aston (Fox as “of Aston” also too close to Francis date for same
family). Francis Baston 23 Apr 1764 Wm & Mary (named in
Francis Baston's 1819 Will as son of his brother William). John Baston
17 Feb 1771 to Wm & Mary (suspect as n/t in transcript
except a John to Henry & Mary which is marked as faint ).
We can also
deduce that Elizabeth 1764 is not a sister to Francis 1764 as she was baptised 3
months later in 1764, she is also shown as of Aston.
With “of Aston” in
mind, then William 1760 and Joan 1762 would also be to Fox. William 1758 and
Thomas 1761 would therefore be to Honeybone as there is no mention “of Aston”
The final result is:-

Bampton aforesaid and that the above bounden Francis Bason is the father of the
said child.
The condition of this recognizance is such that if the above
bound Francis Bason do & shall appear at the next general quarter sessions of
the peace to be holden for the said county & shall abide and perform such order
or orders as shall be made in pursuance of an act passed in the eighteenth year
of the reign of her late Majesty Queen Elizabeth concerning Bastard & Begotten
and born out of lawful Matrimony.

Baston of Glympton Lodge in the parish or liberty of Glympton in Woodstock in
the county of Oxford, yeoman. First I direct that all my just debts funeral and
testamentary expenses to be paid by my executors hereinafter named as soon as
may be necessary after my decease out of my personal estate.
I give,
devise and bequeath unto Thomas Skinner of Witney in the said county, salesman
and my nephew John Baston of Aston Clinton in the county of Berkshire,
gentleman all and every my messuage lands tenements and affidavits? and all my
personal estate monies, securities for money, debts, goods, chattels and effects
whatsoever and wheresoever except my wearing apparel which I shall die origin of
or possession of or entitled unto hold the same unto the said Thomas Skinner and
John Baston their heirs executors admons assigns upon trust to collect call in
and compel payment of all debts and monies which shall be owing to me at the
time of my decease in such manner as they or survivor of them shall think fit

may be owing or appear to be owing to me at the time of my decease and to give
or allow such reasonable time for payment thereof as they or he shall think
proper and upon receipt of such monies or any part thereof upon trust that they

at interest upon covenant or real security and from time to time call in and
replace the same or any part thereof and transfer and dispose of all or any of

rent interest and provides shall otherwise be subject or liable to the control

the survivor of them and his heirs do and shall sell absolutely dispose of my
said messuages and real estate and every part thereof either together or in
parts and either by public auction or private contract as they or he shall think
best for such principle or principles or sum or sums of money as in their or his
opinion may be obtained or reasonably expected for the same and to convey the
affidavits and promises and shall be so sold to the purchaser or purchasers

late brother William Baston the sum or legacy of five shillings apiece to be
paid within three months next after my decease.

thereto belonging or appertaining To Hold unto my said son and daughter their
heirs and assigns for ever tenants in common and not as joint tenants .
Also I give devise and bequeath unto my said son all those two closes of grass
ground called Nicholes Close and late Brandons Field Also one close of arabel
land called the Brick Field and also all other my Freehold and Leasehold closes
and pieces or parcels of common field land and common meadow ground in my own
tenure with al barns stables difices and buildings now standing and being
thereon and all other rights members hereitaments and appurtenances to the said
Closes of meadow or grass ground and arable land and several pieces and parcels
of Common Field Arable Land and Common Meadow ground belonging or in any wise
appertaining To Hold immediately after the decease of my said Wife unto my said

of my brothers John Baston, William Baston, Thomas Baston, Edward Baston and
Jonathan Baston who shall be living at the time of the decease of my said
daughter equally share and share alike or their legal representatives to whom

after paying such monies to my said trustees shall be answerable for or be
obliged to see to the application or in any respect accountable for or by reason
of the misapplication of the same monies or any part thereof and that it shall
be lawful for my said trustees and the survivor of them to deduct and retain to
and for themselves and himself by and out of the said trust monies all costs
charges and expenses whatsoever to be incurred by such sale or sales as
aforesaid and also for journeys and other expenses whatsoever to be incurred in
and about the collecting and getting in any debts and monies or in or about any
other matter or thing relating to the execution of this my will and further that
neither of my said trustees their heirs executors or admons shall be answerable
or accountable for any more money than what he or they shall respectively
actually ------ by virtue of this my will nor shall either of them be charged or
chargeable with or accountable for the receipt or receipts of the other or
others of them but such of them for his own acts receipts and defaults only and
that they or either of them shall not be answerable for any loss which may
happen in placing out or investing the said trust monies in or upon any such
stocks funds or ------- or in exchanging or varying the same under or in
pursuance of the powers hereinbefore contained whether by the reason of the
insufficiency or sufficiency of any security or securities upon which any such
trust monies shall be placed out or invested or in depositing the same in any
bank or bankers hands or elsewhere for safe custody or otherwise in the due
execution of the same trusts save only and except such loss shall happen or be
occasioned by or through his default or negligence.
And I nominate and
appoint the said Thomas Skinner and my said nephew John Baston joint
executors of this my last will and testament in witness whereof I the said
Francis Baston the testator have to this my last will and testament contained in
three sheets of paper by my hand and seal this twenty seventh day of November in
the year of our Lord one thousand eight hundred and nineteen Francis Baston
signed sealed published and discharged by the said Francis Baston the testator
as and for his last will and testament in the presence of us who have subscribed
our names as witness thereto in his presence at his request and in the presence
of each other.

that on the 16th day of November 1822 a Probate of the Last Will & Testament of
Francis Baston late of Glympton Lodge near Woodstock in the County of Oxford
deceased was by authority of the Prerogative Court of Canterbury granted and
committed to Thomas Skinner and this Deponent the nephew of the said deceased
the Executors named in the said Will that the said deceased who in the said
Probate is described as follows "Francis Baston, late of Glympton Lodge near
Woodstock in the County of Oxford" is as this Deponent hath been informed and
------ described in the Books kept at the Bank of England "Francis Bastin,
Bailiff to Mrs Way of Glympton Park Oxon"
And he further made Oath
that he hath been informed and ------ that in order to enable himself and his co
Executor to receive the Dividends and transfer the stock standing in the
deceased name in the said Bank it is -------- to describe the said deceased in
the said Probate as follows Francis Bastin otherwise Bastin late Bailiff to Mrs
Way of Glympton Lodge near Woodstock in the County of Oxford.
And he
lastly made Oath that Francis Baston or as aforesaid described in the said
Probate and Francis Bastin or as aforesaid described in the said Books at the
Bank of England was one and the same person and not divers.
On the
thirteenth day of October 1827 the said John Baston was duly sworn to the truth
of this Affidavit at Aylesbury in the County of Bucks, signed John Baston.

The last Will & Testament of Francis
Baston of Glympton Lodge in the parish or liberty of Glympton in Woodstock in
the county of Oxford, yeoman. First I direct that all my just debts funeral and
testamentary expenses to be paid by my executors hereinafter named as soon as
may be necessary after my decease out of my personal estate.
I give,
devise and bequeath unto Thomas Skinner of Witney in the said county, salesman
and my nephew John Baston of Aston Clinton in the county of Berkshire,
gentleman all and every my messuage lands tenements and affidavits? and all my
personal estate monies, securities for money, debts, goods, chattels and effects
whatsoever and wheresoever except my wearing apparel which I shall die origin of
or possession of or entitled unto hold the same unto the said Thomas Skinner and
John Baston their heirs executors admons assigns upon trust to collect call in
and compel payment of all debts and monies which shall be owing to me at the
time of my decease in such manner as they or survivor of them shall think fit
and I do authorize and empower my said trustees and the survivor of them to
compromise or compound or submit to arbitration any sum of sums of money which
may be owing or appear to be owing to me at the time of my decease and to give
or allow such reasonable time for payment thereof as they or he shall think
proper and upon receipt of such monies or any part thereof upon trust that they
my said trustees or the survivor of them do and shall put and place the same out
at interest upon covenant or real security and from time to time call in and
replace the same or any part thereof and transfer and dispose of all or any of
the securities whereupon the said trust monies shall be then placed out or
invested as they or he my think proper and do and shall pay the interest
dividends or annual profits arising there from together with the rents assigns
and profits of my said messuages and real estate unto the proper hands of my
daughter Elizabeth Baston for and during the term of her natural life by
equal half yearly payments and I do hereby direct and declare that her receipt
alone notwithstanding any future -our-ure (coveture?) shall at all times be a
good and sufficient discharge to my said trustees for the same and that such
rent interest and provides shall otherwise be subject or liable to the control
of any husband she my hereafter marry nor shall the same or any part thereof be
subject or liable to his debts or engagements and from and immediately after the
decease of my said daughter upon further trust that they my said trustees and
the survivor of them and his heirs do and shall sell absolutely dispose of my
said messuages and real estate and every part thereof either together or in
parts and either by public auction or private contract as they or he shall think
best for such principle or principles or sum or sums of money as in their or his
opinion may be obtained or reasonably expected for the same and to convey the
affidavits and promises and shall be so sold to the purchaser or purchasers
thereof and do and shall stand and let possession of the monies arising by such
sale or sales upon trust to pay share and divide the same and also the monies
hereinbefore directed to be paid out at interest for the benefit of my said
daughter unto amongst all and every my nephews and nieces, sons and daughters
of my brothers John Baston, William Baston, Thomas Baston, Edward Baston and
Jonathan Baston who shall be living at the time of the decease of my said
daughter equally share and share alike or their legal representatives to whom
respectively I hereby give and bequeath the same and direct the same to be paid
and divided as soon as conveniently can be after the decease of my said
daughter.
I give unto my nephew Francis Baston, son of my said
brother William all my remaining apparel of every description
I give
unto my said trustees Thomas Skinner and John Baston five guineas each and I do
hereby declare and direct that the receipt or receipts of my said trustees or
the survivor of them or their or his heirs executors or admons shall be good and
sufficient discharge or discharges to the purchase or purchasers of my said real
estate or any part thereof and also to any mortgagor or other person or persons
paying in any mortgage or other monies placed out at interest as hereinbefore
directed or any debt or debts sum or sums of money due to me at the time of my
decease for such sum or sums of money which shall be by him her or them paid to
my said trustees in respect of such purchase or mortgage money security or debt
or debts or so much thereof as in such receipt or receipts shall be acknowledged
to by ------- and that no such purchaser mortgagor or other person or persons
after paying such monies to my said trustees shall be answerable for or be
obliged to see to the application or in any respect accountable for or by reason
