do make and ordain this my last will and testament in manner and form following
That is to say first I commend my soul into the hands of Almighty God hoping and
assuredly believing through the merrits and passion of my Lord and saviour Jesus
Christ to be eternally saved and to inherit everlasting glory and my body I
commit to the earth to be decently buried at the discretion of my Executor
herein after named and concerning my worldly estate as it hath pleased God to
bless me with I dispose of the same as follows.
First I give and
bequeath unto my sister Deborah the wife of John Cook all that my half
yard-lands containing by estimation ten acres 80 the more or less lying in the
common fields of the said East Hendred with all and every the appurtences
thereunto belonging which I hold by Copy of Court Roll to hold to she my said
sister Deborah Cook and to her heirs forever after.
I give and bequeath
unto my brother Thomas Baston five pounds of good and lawfull money of
great Britain and also I give and bequeath unto Deborah the daughter of my said
brother Thomas Baston five pounds of the lawfull money both which said five
pounds to be paid so bequeathed by my Executor herein after named within a
twelve month after my decease.
Also I give and bequeath unto my cousin
Thomas Baston son of my late brother William Baston all my right and
interest in a messuage and appurtenances belonging to the same which said
messuage and appurtenances was late in the tenure of Thomas Castle deceased who
before his death did surrender the said messuage with the appurtences to my use
as security for the payment of a sum of money by me left him. To hold my said
cousin Thomas Baston and his heirs for and during the said time that the money
remains unpaid and when the said money shall be paid I give and bequeath the
whole that is or shall be due to me at the time of payment to my said cousin
Thomas Baston and his heirs forever.
Also I give and bequeath unto my
cousin John Baston son of my late brother John Baston five pounds of like
lawfull money.

nature or kind so ever my debts being paid and my funeral expenses discharge I
give and bequeath unto my said sister Deborah the wife of John Cook whom

Thousand seven hundred and forty two before the Worshipful Robert Dale Doctor of
Law surrogate to the Right Worshipfull John Bettesworth also Doctor of Law
Master keeper or Commissary of the prerogative Court of Canterbury lawfully
constituted by the oath of Deborah Cook wife of John Cook the sister of the
deceased and sole Executrix named in the said Will to whom was granted
administration of all and singular the Goods Chattels and Credits of the said
deceased being first sworn duly to administer." Messuage - Dwelling house
with out buildings and land assigned to its use. Appurtenances - Belonging,
appendage or accessory. " Mention of John as late brother in Elizabeth

Susannah Palmer. " Thoughts on sorting out the children of:- John Baston &
Mary Spinnage m 10 Oct 1697 Bampton, (we therefore assume John is of Bampton).
John Baston & Susanna Palmer m 26 Oct 1699 Begbroke, both of Aston,
(probably shown as Jn Jnr), note this marriage is shown on the IGI as 1679
but is clearly 1699 when you view the original register. John Baston &
John Beeche m 23 Jan 1708 (1707/8) Clanfield, both of Cote
(Bold
words are the facts from either the Baptism Registers or the 1742 Will. All
dates have been corrected to the post 1725 Julian calendar (1st January to 24th
March were shown as of the previous year before 1725) but are also shown in
parenthesis as uncorrected/corrected (1707/8) years.
From the 1742 Will
of Elizabeth a spinster we know that Mary, John, Elizabeth, Ann, Francis &
William are all sons of the same John as she mentions them all, as of
her brother John.
There is only one Mary baptised to a John around the
required period, this is to a Jon, 25th September 1698. As the only
couple married at that time were John Baston and Mary Spinnage, this should
therefore be the John named in the 1742 Will.
Likewise, there is only one
Ann baptised around the period, this is to a Jn, 20th December 1703, so
Ann is also to John & Mary Spinnage Baston. (Ann is also Mary Spinnages
mother's first name).
And again, there is only one Francis, baptised 22nd
June 1705 to a John, so we can allocate Francis to John & Mary Spinnage
Baston.
This leaves John, William and Elizabeth (who is named as the wife
of John Bennett in the 1742 Will, they were married 9th Oct 1725 Bampton).
For John, we have two possibilities, John baptised 17th March 1700 (1699/1700)
to John and John 15th December 1702 to Jn Jnr. There is a Susanna
shown as being baptised 1st January 1701 (1700/01) to Jn Jnr of Aston, we
can, I think, assume this Susanna would have been the first daughter to John &
Susannah Palmer Baston of Aston, therefore the John shown baptised to Jn Jnr,
would be to John & Susannah Palmer Baston, which leaves the John baptised 1700
to John & Mary Spinnage Baston.
Elizabeth, there is only one shown for
the period, 17th May 1702 to Jn. This is only seven months before the
baptism of the John to Jn Jnr (John & Susannah Palmer Baston) shown above, so we
can safely assume this Elizabeth is to John & Mary Spinnage Baston as it is too
close to the baptism of John in December 1702 .
Finally we come to
William. We have a William 2nd June 1703 to Jonathan and William
baptised 1st December 1708 to John. We know from the 1742 Will that both
a William of Jonathan is mentioned, as is a William of John, so the two Williams
are as the baptisms show, William 1703 to Jonathan and the William baptised 1708
is to William & Mary Spinnage. There are no other Williams to a John so this is
the only possibility, it can't therefore be a first child baptism to John & Joan
Beeche.
So the children to John & Mary Spinnage Baston are, Mary 1698,
John 1700, Elizabeth 1702, Ann 1703, Francis 1705 & William 1708.
To John
& Susannah Palmer Baston we now have, Susanna 1st January 1701 (1700/01), John
5th December 1702, Joseph 13th July 1707.

unto my brother Thomas Baston five pounds of good and lawfull money of
great Britain and also I give and bequeath unto Deborah the daughter of my said
brother Thomas Baston five pounds of the lawfull money both which said five
pounds to be paid so bequeathed by my Executor herein after named within a
twelve month after my decease.
Also I give and bequeath unto my cousin
Thomas Baston son of my late brother William Baston all my right and
interest in a messuage and appurtenances belonging to the same which said
messuage and appurtenances was late in the tenure of Thomas Castle deceased who
before his death did surrender the said messuage with the appurtences to my use
as security for the payment of a sum of money by me left him. To hold my said
cousin Thomas Baston and his heirs for and during the said time that the money
remains unpaid and when the said money shall be paid I give and bequeath the
whole that is or shall be due to me at the time of payment to my said cousin

such that whereas John Baston the younger late of Aston in y parish of Bampton
dyed intestate without making any will. And whereas Elizabeth ye relict of John
Baston aforesaid administrix upon ye goods & chattels & credits of her said
husband died intestate as aforesaid and departed this life having several of ye
goods & chattels of the said John Baston her husband died without making any
alteration in ye property of said goods & chattels. Whereof ye Admion of all
and singularly ye goods, credits & chattels of ye said John Baston died yet
remaining in ye same property and not administered by ye said Elizabeth Baston
by ye authority of ye official above named comanded and granted unto ye above
bounden John Baston son of Admintrix of John Baston ye younger aforesaid who
died intestate. If therefore ye said John Baston ye adminstor aforesaid do well
and truly adminster in & upon ye said goods chattels & credits of ye said of ye
said died not administered as aforesaid. And also do exhibit into ye registry
of The Archons Court of Oxon a true and perfect inventory of all & singular ye
goods credits & chattels of ye said died not administered as aforesaid moreover
do render a just account of & upon ye said admion when they shall show to
lawfully required And such part or portion of the residue of ye said goods as
shall found to remain upon there said account duly examined and allowed shall
distribute dispose & pay unto to such persons as ye Judge or Judges for the time
being of the said court by his or their decree or sentance persuant to law shall
limit & appoint. And lastly do & shall have & defend harmless & indemnified ye
official above named & all other ye Officers of ye said Court against all person
whatsover from any danger or damage that may befall them for or by reason of
granting ye said administration to ye said John Baston then this obligation to
be voyd or else to remain in full force & vertue.

BETWEEN Thomas Horde of Coate in the pish (parish) of Bampton in the county of
Oxon Esq of _____ and John Baston freeholder of Aston in the said parish of
Bampton in the said county of Oxon yeoman of ______ doth witnesseth that the
said Thomas Horde for & in consideration of the sum of one hundred & forty
pounds & ten shillings of lawful English money to him in hand paid by the said
John Baston the elder at or before the sealing and ____isery hereof the receipt
whereof he the said Thomas Horde doth hereby acknowledge & thereof and every
part thereof doth acquire exonerate and discharge the said John Baston the elder
his heirs executors, admins and assigns & every of them for ever by these
present & also for and in consideration of the yearly rent and covenant herein

& territories of Aston & Coate aforesaid now or late in the tenure or occupation
of John Baston deceased the grand father of the said John Baston party to
those present which said premises are part(?) of one yard lands and a half,
tenured by said Thomas Horde senior the father of the said Thomas Horde unto the
said John Baston deceased for the term of ninety nine years as the said John
Baston deceased, Elizabeth his wife & John Baston their son or either of
them should see long ___ and the same mentions & expresses in a schedule or
eering(?) to those present annexes and also all land meadows crops & lets of
meadow ground commons pasture feeding waters _____ commodities instruments &
advantages whatsoever to the said one half yard lands and other the premises
belonging or appertaining or to or with the same or any __ thereof used occupied
or enjoyed as p_ptell or member thereof with there and every of there
appurtenances and the extension(?) or extensions(?) damage or damages of the
said premises with their appurtenances & all & every the rent or rents reserves
& or payable upon any demise made of the said premises or any part thereof
except & out of this present lease & grant always excepted & reserve unto the
said Thomas Horde his heirs & assigns all & every the timber trees & trees
likely to be timber of all sorts & kinds & all & every the fruit trees growing &
being or hereafter to be growing or being in & upon the said premises or any
part thereof together with free liberty power & authority of ingress, ingresses
& regress may & pass unto for the said Thomas Horde his heirs & assigns & to &
for his & their servants, cart, carts & carriages at all _iff & reasonable times
of the year to fell cut do__ dig, grub, cap & carry away the said timber trees &
every or any of them at his & their wills & pleasures and also accept and
reserves all and every the fishing, fowling, hawking & hunting of and belonging
or pretended to belong to the said demesne premises or any part thereof..
To have and to hold the said one half yard lands & all & singular other the
premises before ___ these present granted or mentioned or intended to be granted
with their and every of their appurtenances except before excepted unto the said
John Baston freeholder his executors admins and assigns form the day of the date
hereof for and during and unto the full end & term of fourscore and nineteen
years from thereunto next ensuing & fully to be complete & indes(?). If John
Baston & Henry Baston the sons of the said John Baston party to those
present or any or either of them shall see long yielding & paying therefore
yearly & every year during the said term and estate before by those present
granted or mentioned to be granted unto the said Thomas Horde his heirs &
assigns for the said one half yard lands & offer his premises with the
appurtenances the yearly rent of said six shillings & nine pence of lawful
money.
(The deed then goes into detail about the various trees and makes
specific mention of oak, ash & elm as the property of Thomas Horde).

the name of God Amen I John Baston of Brighthamton in the parish of Bamton in
the county of oxon yeoman being sick and weak of body but of perfect memory
thanks be to god first doe make ordaine and declare this my last will and
testament in maner and forme following first I bequeath my soull into the hands
of Almighty god my maker trusting in the meritorious death and pasion of my Lord
and Saviour Jesus Christ that my soull shall be saved at the day of the Lord and
as for my temporal efforts which god have blesed me withall I give and
bequeath in maner and forme following.
Item I give to my son John the
sume of one shilling. Item I give to my son Thomas and my son Henry all my
half yeard lands, meadow ground and comons with all the appurtenances there
unto belonging to be equally divided between them upon condition that that they
shall pay thirty pounds out of it which I now am indebted. Item I give all
the rest of my goods cattell corne and hay and all my flock to my son Henry and
my son Joseph and I doe make them my Executors of this my last will and
testament in witness whereof I have here unto sett my hand and seall this eighth
day of may in the eighth year of the reign of our Sovereign Lady Anne by the
