In the name of god almighty I Elizabeth (Isabel crossed out and changed to Elizabeth) Baston of Aston in the said parish of Bampton in county Oxon wydowe being sicke in body but of prefect remembrance thanks be to almighty God do make and ordain this my last will and testament.  First I bequeath my soul unto the hands of almighty God and to my only saviour Jesus Christ and my body to be buried in the churchyards of Bampton.

For my worldly goods I bequeath unto Alice May my kinswoman one red cowe, one flockbed, one paire of sheets, 2 bolsters one coverlet, one blanket, one brass pan containing a gallon and such old stuffe as now I have about the house.

Item I give unto William Bartlet two bushells of Barley and one little kettle.

51662 Agreement betwixt Thomas Horde Esq and the Freeholders, Leaseholders & Copyholders of Aston & Cote, History of Bampton, Rev J A Giles 1847, Pages 7 to 11. "
An Agreement made the four and twentieth day of March, in the fourteenth year (1662) of our Sovereign Lord King Charles the Second, Between Thomas Horder esq Lord of the Manor of Aston Boges in the county of Oxon of the one part and the Freeholders, Leaseholders and Copyholders of the said manor and other the tenants and owners of lands in Aston aforesaid and in Cote, in the said county of Oxon, whose names are hereunto subscribed, of the other part, as followeth viz:

Whereas it is considered that an inclosure of the arable fields of Aston and Cote aforesaid will conduce to the great improvement of every man's lands or living there, Now the said Thomas Horde, for the greater encouragement of his tenants there to make inclosure of any the lands which they there hold of him, doth hereby agree THAT if any tenant of the said Mr Horde having but two lives in his living * or but one life and a widow's estate, and shall make any inclosure, Mr Horde shall bear the third part of the charge AND if the tenant shall have but one life without a widow's estate, then Mr Horde to bear all the charge of every such inclosure, and the tenant to preserve the mounds being once made.

1  AND it is agreed that it shall be lawful at all times hereafter, as well for the Lord of the Manor of the time being as for all or any the tenants and owners of lands in Aston and Cote aforesaid, to inclose all or any their respective arable lands there.

2  AND it is agreed that Mr Horde may as soon as he pleaseth, inclose fifty four field acres of arable land lying together in the Holiwell field next to the capital messuage in Cote aforesaid, which said LIIII acres is as much arable as usually belongs to two yardlands in Aston and Cote aforesaid.

3  AND it is agreed that Mr Horde shall give in exchange to those persons whose lands he shall enclose in the said Holiwell field, other lands of as good value as those for which he shall so inclose, AND that it shall be lawful for any of the said tenants and owners of lands to inclose any lands of the Lord's which are let at any rack rent so as Mr Horde may have other lands in exchange of as good value.

4  AND that upon every inclosure of lands there shall be an abatement of Common proportionable, AND that there shall be likewise abatement of Common for all such little closes as have been formerly inclosed.

5  AND that Mr Horde may inclose as much of Common called Cote Moor, lying next to the orchard of the said capital messuage as the proportion of two yards of common shall amount unto, The quantity and quality thereof being respected, AND that Mr Horde shall in lieu thereof abate all the Commons belonging to two yard-lands.

6  AND the said Mr Horde shall hereby choose two men, viz, John Williams and John Fox, And the said freeholders and other tenants have chosen two other men, viz. Thomas Medhop, Gentn, and Thompson Hancks, Gentn, to settle all differences concerning the said inclosures and exchanges and abatements of common IN ALL which they do hereby agree to submit themselves to the order of the said four men or any three of them, and as often as any of the said four men, so chosen, shall die, then such of the parties who elected the person dying, shall elect another in the place of him dying, who shall have the like power with the person first chosen.

7  AND that all enclosures so made shall continue for ever.

8  AND that all the parties hereunto shall at all or any time or times hereafter subscribe and seal any other articles or agreement to be drawn and made more fully and at large according to the true intent and meaning of them presents, and also do any further act or thing for the perfecting and establishment of this present agreement and of the inclosures to be made as aforesaid.

8 (sic)  AND that after the said inclosures shall be made by the said Thomas Horde, the Hames of meadow shall thenceforth for ever go to the officers of the town and other uses as formerly hath been accustomed, so as the same officers shall be sworn at the Lord's court.

IN WITNESS whereof all the parties hereunto to this present agreement their hands and seals have set the day and year aforesaid

Item I give and bequeath unto my sonn John Baston all my dwelling house & other housing and close thereto belonging and one whole yardlands meadow & commons belonging to it and one long cart, one plow, one sestont?, one horse trow & the plom-s upon condition he shall let my executors enjoy all the crop of corne that shall be standing or growing next after my decease and to have three months liberty to thresh & carry away all the corne & hay & other goods.  
Item I give and bequeath unto my sons Henry Baston and William Baston one halfe yeardlands meadow and commons equally to be divided between them for the terme of my sonn John Baston life.

In the name of god almighty I Elizabeth (Isabel crossed out and changed to Elizabeth) Baston of Aston in the said parish of Bampton in county Oxon wydowe being sicke in body but of prefect remembrance thanks be to almighty God do make and ordain this my last will and testament.  First I bequeath my soul unto the hands of almighty God and to my only saviour Jesus Christ and my body to be buried in the churchyards of Bampton.

For my worldly goods I bequeath unto Alice May my kinswoman one red cowe, one flockbed, one paire of sheets, 2 bolsters one coverlet, one blanket, one brass pan containing a gallon and such old stuffe as now I have about the house.
